Violation Closure Starts Here — But Closure Only Happens When ALL FMCSA Requirements Are Met
If you have an FMCSA Drug & Alcohol Clearinghouse violation, your case cannot be closed until every required step is completed in the correct order. No shortcuts. No skipped steps. No same-day “closure” without full compliance.
Read This Before You Call
Violation closure is not automatic. A Clearinghouse violation remains on record until the driver successfully completes the required Return-to-Duty process and the follow-up testing plan, whichever is later. The steps must be completed in order.
As of November 18, 2024, drivers with a “prohibited” Clearinghouse status can also be denied or lose their CDL or commercial driving privileges at the state level until they complete the required process.

FMCSA Violation Resolution Requirements
To move toward violation closure, the client must complete every required step. These steps cannot be skipped or done out of order.
Checklist
1. Violation must be entered in the Clearinghouse
Employer or authorized party reports the violation into the FMCSA Clearinghouse.
2. Initial SAP assessment must be completed
A qualified Substance Abuse Professional must conduct the initial evaluation. SAPs are required to report the completion date into the Clearinghouse.
3. Client must complete education and/or treatment requirements.
The SAP assigns the required education and/or treatment plan based on the evaluation. The driver must complete what is assigned before moving forward.
4. Follow-up SAP evaluation must be completed
The SAP must determine the client is eligible for Return-to-Duty testing. That determination is then reported to the Clearinghouse.
5. Negative Return-to-Duty test must be completed and reported.
An employer subject to Part 382, or in some owner-operator situations a designated C/TPA, must send the driver for the RTD test and report the negative RTD result. That reported negative result changes Clearinghouse status from “prohibited” to “not prohibited.”
6. Follow-up testing plan must be carried out successfully
The SAP prescribes the follow-up testing plan, and it must be completed successfully for the violation to be fully resolved. FMCSA states the violation remains available until the RTD process and follow-up testing plan are successfully completed, whichever is later.
Bottom Line Notice:
If even one requirement is incomplete, the violation is not closed.

FAQ 1: Can I pay for violation closure online?
No. This service cannot be purchased online. You must call to purchase.
FAQ 2: Can my violation be closed the same day?
Not unless all FMCSA requirements have already been completed and properly reported where required. The RTD process must be completed in order.
FAQ 3: Is a SAP evaluation alone enough to close my violation?
No. A SAP evaluation is only one step. The driver must also complete required education/treatment, be found eligible for RTD testing, have a negative RTD test reported, and complete the follow-up testing plan for full resolution.
FAQ 4: What happens if my Clearinghouse status is prohibited?
You cannot legally perform covered safety-sensitive functions, and since November 18, 2024, that status can also affect your CDL or commercial driving privileges at the state level.
